Pineda <br />Director <br />In a letter dated January 8, 2010 the Colorado Division of Reclamation Mining and Safety, in the <br />process of reviewing liability amounts, found that the permit system has produced a slight discrepancy <br />in the Trapper Mine's liability amount. The error occurs from the TR-104 decision and the TR-105 <br />decision. It appears that our permit system did not include the liability amount of $19,479,903.00 <br />approved in TR-104 for previous amount listed for TR-105, instead, using the amount of <br />$20,378,236.00. <br />This discrepancy in our system resulted in the approved liability amounts for TR-105 and PR-6 to be <br />higher than liability required. Based on this discrepancy, the Division informed the Trapper Mine that <br />it is currently over bonded by $898,333.00. However, this amount is incorrect as the reclamation cost <br />estimate for the entire mine site was updated with PR-06 which makes the original $30,099,557.00 <br />amount correct. However, due to this discrepancy and an entire update the revised change in liability <br />amount for PR6 should be $10,391,998.00. This amount changes both decision forms for TR106 and <br />TR107. Also TR107 change in liability puts the revised liability at $30,173,724.00. This is an <br />increase of $74, 167.00 than the bond held of $30,099,557.00. The revised decision forms for the <br />above mentioned revision are attached. These forms reflect the new liability amounts required for the <br />Trapper Mine's reclamation bond. <br />If you have any questions feel free to contact me.
