Enclosed is additional information addressing issues identified in your technical adequacy <br />letter as well as a summary of information provided: <br />Application Form - see the attached corrected application form <br />Exhibit C - Please clearly show the additional 9.92 acres of affected land that will be added to the <br />existing permit area via this amendment on the Mining Plan map. <br />Revisions have been made to the attached Exhibits C-1 and C-2 to clearly identify the 9.92 <br />additional acres. <br />Exhibit D - Mining Plan (Rule 6.4.4): Please describe the construction of, and show the proposed <br />configuration of the "outlet structures" that are intended to convey the captured flow of Vendette Creek <br />from Cell 3, through Cell 4 and 5 and into Maryland Creek. Please also show how it has been determined <br />that these structures, as well as Maryland Creek, will allow adequate flow to prevent adverse effects <br />from the capture and re-routing of Vendette Creek during a 100 year peak flow event. <br />An extensive hydrology study was completed by Tetra Tech, Inc. to ensure that the introduction <br />of the 100 year flow from Vendette Creek into Cell 3 will be conveyed through Cell 3, 4 and 5 <br />and into Maryland Creek without incident. The outlet structures conveying the flow are shown <br />on the revised and attached version of Exhibit F. <br />EXHIBIT E - Reclamation Plan (Rule 6.4.5): The current reclamation plan states on the first page that <br />"'between 6 and 12 inches of overburden and topsoil will be placed on the lakeshore slopes above the <br />waterline". Please remove the above referenced statement from the first page of the reclamation plan. <br />Topsoil should be handled separately from the overburden used to backfill slopes. The "'Topsoiling" <br />paragraph on the second page contains a more appropriate description of how the topsoil should be <br />handled and replaced. Because the site would be expected to have a surplus of topsoil available for <br />reclamation, the Division recommends that 8 to 12 inches of topsoil be replaced in area E <br />MAY 17 2010 <br />of Redamatim,
