BOX 18087 <br />Boulder, CO 80308 <br />RE: Bonser Pit; DRMS File No. M-2000-156; Adequacy Review -- 03 <br />Dear Mr. Wayland, <br />The Division of Reclamation Mining and Safety (Division) has identified several other <br />comments and questions that must be addressed prior to the Division's decision due date. Please <br />be advised that if you are unable to satisfactorily address any concerns identified in this <br />review before the decision date, it will be your responsibility to request an extension of the <br />review period. If there are outstanding issues that have not been adequately addressed <br />prior to the end of the review period, and no extension has been requested, the Division will <br />deny this application. <br />6.4.12 Exhibit L - Reclamation Costs <br />The Applicant has proposed posting the reclamation bond in phases. Rule 4.2.1(4) requires <br />that the Financial Warranty shall be sufficient to assure the completion of reclamation of <br />affected lands if the Office has to complete such reclamation due to forfeiture. Please commit <br />to notifying the Division in writing prior to opening a new mining phase(s). At such time the <br />Applicant shall provide the Division with the increased financial warranty and associated <br />bond forms. Please note that the financial warranty that the Applicant has proposed for each <br />phase is subject to Division review upon receipt of notification to open a new phase. The <br />Division shall add the following commitment to the Bonser Pit: <br />Coulson Excavating Co., Inc. shall request in writing to the DRMS that the financial <br />warranty be increased prior to opening an additional phase (s). An increase of the financial <br />warranty shall be requested, and provided with the letter to DRMS, by Coulson Excavating <br />Co., Inc. to its bonding/surety prior to opening and mining additional phase (s). The <br />increased financial warranty and updated bond forms shall also be provided to the DRMS <br />from Coulson Excavating Co., Inc. bonding/surety provider. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
