It is our understanding that SW Chambers'
request is specific to the financial warranty associated with the slurry wall only, and
does reduce the financial warranties associated with the ongoing site operations and
other reclamation requirements.
As the owner of the underlying property, the City and County of Broomfield does not
have any comments or objection to the proposed reduction. Our position is based on
the assumption that the permit holder (i.e. site operator) will continue to be liable for
maintaining and protecting the slurry wall during mining activities.
Thank you for providing us the opportunity to provide comments and please contact me
at (303) 438-6348 if you have any questions.
Sincerely,
David Allen
Deputy Director of Public Works - Operations
