The Lafarge <br />Company holds an "Amended and Restated Agreement for Lease of Site" dated September 10, <br />2008 which was in effect when my clients acquired the subject property last year. <br />We've received notice from Lafarge that it intends to file a "Technical Revision" to its <br />mining permit. When my clients obtained the property, the existing reclamation plan was to <br />"backfill the majority of the pit with washed fines, overburden and other inert materials from <br />nearby sand and gravel operations." Apparently Lafarge thinks they can unilaterally change that <br />to open exposed ponds and the landowner disputes that. <br />If and when Lafarge files either a Technical Revision or seeks to file an amendment for <br />this mining permit, I would appreciate it if you would see that a copy of any such material is <br />forwarded to the undersigned as the representative of the landowners. <br />Thanks in advance for your cooperation, <br />Very truly yours, <br />Timothy J.
