Division Director PO Box 772 Natural Resource Trustee
Philomath, OR 97370
Re: Ophir Lode, Permit M-2001-063, Technical Revision (TR-0 1), Weed Control Plan: Approved.
Dear Mr. Giesy,
I have received your packet dated 2/28/10, which included the details of the weed control plan and J. Barry
Custom Weed Control Inc.'s letter detailing the proper chemicals and scheduling of future treatments at the
site. These items were found to fulfill the adequacy requirement for the technical revision. The technical
revision has been approved, as of today's date.
As noted previously in my 1/13/10 letter to you, the problem stemming from the presence of the noxious
weeds and the lack of a weed control plan has been abated.
I appreciate your concern with pursuing a thorough weed control plan developed by Mr. Barry. I look
forward to seeing the young infestations brought under control and, eventually, eliminated. Please be
reminded that the activities carried out and their effectiveness should be reported in your annual reports.
There is no increase to the existing bond amount for this weed control plan, since its associated costs were
included in the original bond estimate. This technical revision simply defines what the plan consists of.
If you have any questions, you may contact me at the Division's Durango field office : 691 CR 233, Room
A-2, Durango, CO 81301; telephone 970-247-5193. I hope that we can meet at the site this summer.
Sincerely,

Bob Oswald
Environmental Protection Specialist
Ec: Steve Shuey, DRMS
(c:\10-03 docs\ophir lode tr01 appr/rco)
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
