The inspection procedure consists of two parts: a review of records,-and an on-site facility <br />inspection. Findings associated with the inspection are detailed in the enclosed inspection report. <br />The Division expects Asphalt Paving Company to correct the findings noted in the enclosed inspection report and <br />submit an explanation on how each finding was corrected. Pursuant to Part II.B.2 of the Colorado Discharge Permit <br />System General Permit for Stormwater Discharges Associated with Sand and Gravel Mining and Processing <br />Activity (the stormwater discharge permit), Asphalt Paving Company must submit the requested materials to the <br />Colorado Department of Public Health and Environment, WQCD-P-B2, 4300 Cherry Creek Drive South, Denver, <br />CO 80246-1530, Attn: Kathleen Rosow, by March 15, 2010. <br />Note: All applications, reports, and other information requested by the Division must be signed in accordance with <br />the provisions of sections 61.40)(e) and (f) of Regulation No. 61, and must contain the following certification <br />statement: <br />"I certify under penalty of law that this document and all attachments were prepared under my <br />direction or supervision'in accordance with a system designed to assure that qualified personnel <br />properly gather and evaluate the information submitted. Based on my inquiry of the person or <br />persons who manage the system, or those persons directly responsible for gathering the <br />information, the information submitted is, to the best of my knowledge and belief, true, accurate, <br />and complete. I am aware that there are significant penalties for submitting false information, <br />including the possibility of fine and imprisonment for knowing violations." <br />This Compliance Advisory is intended to advise Asphalt Paving Company of possible violations of the Colorado <br />Water Quality Control Act, its implementing regulations and permits, so that it may take appropriate steps to avoid <br />or mitigate formal enforcement action. This Compliance Advisory does not constitute a Notice of Violation or Cease <br />and Desist Order and is not subject to appeal.
