Martin <br />Executive Director <br />On February 23, 2010 the Division of Reclamation, Mining and Safety (Division) received a technical revision <br />(TR-03) request for the Camilletti Milner Pit #2 project. The Division is required to make a decision no later <br />than March 25, 2010; therefore your response to the following concern should be submitted to the <br />Division as soon as possible. <br />The technical revision proposes a revision to the Mine Plan Map for the amendment area and to incorporate <br />the Construction Plans for the Bridge and Conveyor over Trout Creek into the permit. In the technical <br />revision letter dated February 19, 2010, the Operator states the Army Corps of Engineers has decided not to <br />issue a 404 permit to provide off-site mitigation of the affected wetlands within the pit boundary and will <br />allow excavation of the wetland areas under the Tulloch Rule. <br />Please provide the Division with documentation from the Army Corps of Engineers of their decision regarding <br />the 404 permit. <br />If you have any questions, please contact me 303-866-3567 ext. 8124. <br />Sincerely, <br />Peter S.
