Martin
Executive Director
We have completed a preliminary adequacy review of the above-referenced submittal, and have the
following comments.
1. We are waiting for verification from the State Historic Preservation Officer (SHPO) that the
proposed refuse disposal area on private land will not adversely affect a place that is listed on or is
eligible for listing on the National Register of Historic Places. This verification from the SHPO is
required by Rule 2.07.6(2)(e)(i). Should additional site surveys be necessary, the Division will
consider the possibility of approving TR-120 with the stipulation that the surveys and SHPO
clearance be provided before disturbance occurs. We requested verification from the SHPO in a
letter dated January 11, 2010.
2. Please extend the areas shown on Maps 54C and 54D southward so that all proposed new
disturbance is shown.
3. Please revise Map 54C to show details of the sediment and drainage control features so they are
consistent with those shown on Drawing C-13 of Exhibit 82, and use the same symbol scheme
and line weights as shown on Map 54C in the Main Surface Facilities Area.
4. Will the clean water ditches drain to the sediment control ponds as shown on Map 54C?
5. Please explain how the maximum pitch grade limit of 15 percent [Rule 4.03.1(3)(a)(iii)] will not
be exceeded, given the steep grades shown for haul road switchbacks on Map 53.
6. Please add a table to Exhibit 82 showing culvert design information for the haul road culverts.
Office of
Mined Land Reclamation
Denver • Grand Junction • Durango
Office of
Active and Inactive mines
