Division of Reclamation, Mining and Safety
1313 Sherman St. Room 215
Denver, Co. 80203
Dear Mr. Bird:
Division of Reclamation,
-Al Mining & Safety
v With regards to the Amendment-AM-4 application submitted by the 120d Estates-Partners; - - -
we recognize that the Division fo Reclamation, Mining and Safety must calculate a financial
warranty that would be sufficient to reclaim the property in the event of bond forfeiture.
In the worse case scenario, the forfeiture would occur after the pit has been fully excavated, and
before the clay liner is installed and backfilled.. Because the importation of backfill is potentially
costly, in order to reduce the financial warranty required for the property, we hereby grant DRMS
permission to use the stockpiled material on the land we own just east of the currently permitted
as M-2001=85 (Corrigan Lot 2). Such use would be exclusively for the reclamation to the site
that is permitted as M-2001-85. DRMS reserves no right to use the materail for any other
purpose.
Yours Truly
Les Ewegen ?'??
Project Manager
