(ASCI) agrees that prior to release of the reclamation bond for this permit by the DRMS, it (ASCI) will develop a <br />legally recorded instrument approved by the MLRB that will create a permanent covenant to run with the property <br />requiring that whosoever owns or controls the property will maintain the perimeter drain in good working condition and will <br />inspect the drain workings a minimum of once every two years and should conditions warrant, will clean the system and <br />replace any required components to return the system to good working order. <br />If this language satisfies the final adequacy concern of the DRMS for amendment AM-4, please let me know. Please also <br />let me know that this e-mail message committing to this requirement is adequate and that a letter by US mail is not <br />required.
