Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
The Division received your review of the Peabody Sage Creek Mine application on August 31, 2009. The
Division forwarded the Division of Wildlife's concerns to Peabody Sage Creek Coal Company (PSCCC)
on January 4, 2010. The permittee, PSCCC, requested additional information regarding CDOW's
concerns. Specifically, the permittee asked for the locations of the two Columbian sharp-tailed grouse
leks, and the five Golden eagle nests identified by CDOW. Information regarding the locations of these
potentially impacted sites should allow the permittee to address CDOW's concerns.
Peabody Sage Creek Coal Company has also requested that Alpine fescue (Festuca brachyphylla) be
allowed to remain in their reclamation seed mix. The Seneca Coal Company operations, Seneca II,
Seneca II W, and Yoast mines have included this species in their seed mix for year with favorable results.
If you would like to contact PSCCC directly with the lek and nest information, the manager of
environmental services is Mr. Vern Pfannenstiel, Peabody Energy Corp., 3001 West Shamrell Boulevard,
Suite 110, Flagstaff, AZ 86001. Thank you for your review and comments.
Sincerely,
__?.. .-._ _._._._--
i Binns
Protection Specialist II
6-3567 ext. 8107
Office of
Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
