NX I UO$ <br />JAN 0 4 x.010 <br />Division u ;tion, <br />Mining G. _ ioty <br />Dear Sandy: If this Permit- Revision is not withdrawn, we are requesting an informal hearing, (as <br />per the telephone message) that according to the law, the hearing will be taped, a newspaper <br />public notice will have to be given in a local paper 2 weeks in advance with day, time, and place. <br />Everyone that filed a complaint, an objection, or comment, or has any interest may attend, and be <br />permitted to speak. We are also requesting a tape or transcript of the meeting that we begged all <br />you to go and attend in Grand Junction and where I was misquoted and I thought we had that all <br />cleared up-1 share will do 2 acres. <br />Any opemtors(WFC) that willfully and knowingly profjided ` i nfonnatiion in any plan, <br />revision, permit, or documentation, or documented material to the DR�Mcan be fib $10j000 <br />or up to one year imprisonmumt or fine and imprisonment. WFC has no only provided and <br />documented False information, but they have maliciously done so, with years of forethought. <br />In Permit Renewal #5 DBMS allowed WFC to change the Martin Farm from Irrigated Farmland <br />to Dry land when WFC knowingly knew that this place use to be beautiful hay fields and even <br />after I reclaimed it, I got numerous cuttings of hay off this property while employed by WFC. <br />WFC willfully and knowingly have the farmers SHUT THEIR WATER OFF TWO YEARS IN <br />ADVANCE as they did the Sunshine Place, so that when the DRMS arrives to do an inspection <br />all the DRMS sees is a dried up piece of property with prairie dog holes and looks horrible as did <br />James Johnsons and ours. WFC has already began drying up other areas even though it will not <br />be mined for 2 years. WFC also takes pictures of the property when NO irrigation is being done <br />because of seasonal or when we are just about to replant and then claims we never irrigated it. <br />WFC also claims that farmers only do one cutting in this area is totally false and they know it <br />because even at the mine I did three cuttings.. <br />WFC also knows by attending numerous CC ditch board meetings, that the water is NOT <br />attached to the property and I repeat is NOT ATTACHED to the property and can be moved <br />from one piece of property to another at anytime and can be restored to that property when <br />needed or even more or less can be restored. If the landowner has the shares, (Morgans is the <br />largest share holders in the CC ditch) they can take whatever amount they want and put it <br />wherever they feel it is necessary at any time. So, if more water was needed, a paper is filled out <br />at the CC ditch company and it says how many shares of water a person wants to move and <br />where. If new landowners take possession of the property, as did Dirk Richards, that they have <br />enough water to put the Martin place into a swamp as do we if we wanted to. This was in the <br />recent permit 5 renewal and should have never been approved and we are objecting to that. WFC <br />knowingly and willingly and maliciously refused more water so that WFC could convince the <br />DBMS that there is not enough water available to farm these properties by any means possible, <br />even building WFC own weather station and no expense spared to hire people to try and prove <br />
