ml-00K
,Pk
Division of Reclamation, Mining, and Safety
1313 Sherman Street Room 215
Denver, Colorado 80203 JqN 0 4 2010
December 31 2009 ®w„s-y,, , .
' Min6
a ^d Safety
Dear Sandy, Marcia, and Dan
Irrigation is an Art and the science of irrigation is Trial and Error. Ross, he's a genius.
He is a very brilliant man that can work numbers until they look GREAT ON PAPER,
but to apply everything that looks great on paper does not always work in the REAL
world. Irrigation is an art that the farmer is always trying to better and perfect by the
science of trial and error. Ross and I spent hours trying different nozzles -and different
size sprinklers to get the most efficient coverage, and applying the water needed, in the
best time suitable for a particular crop. In fact, Ross is the one that first ordered the 404
sprinklers and used the 1 /4 inch nozzles. Ross came to the SUNSHINE corner and put a
pressure gauge in and we ran test together and WOW, even with 18 pounds of pressure
the sprinkler worked great and did excellent coverage. We were both shocked. Ross
knows all of these things and because he is so smart, he can present DRMS with partial
facts or very untrue facts and he can arrange his numbers in such a manner, that everyone
THINKS this is the right answer, but it is not. AND instead of helping to perfect the
system with his knowledge, he continues to lie and misinform people just to hinder and
hurt them and us and to provide information that is FALSE to the DRMS to convince the
DRMS that we don't have enough water. So far, the laws state that there must be a
dependable water SOURCE in place and there has been since the early 1900's and I will
have the Ditch board submit another letter stating that. As to the shares needed on any
piece of property, it is all trial and error and after 50 years of irrigating those properties
involved in the Revision, that's pretty much PROOF.
Here's the facts! NRCS was informed by Ross that WFC had a hard time finding
someone to irrigate the property and change the side rolls twice a day. This has been
willfully and knowingly submitted and is a LIE. First off, WE ARE IRRIGATING AND
FARMING THE ENTIRE MORGAN PROPERTY AND HAVE SUBMITTED OUR
COPY OF OUR CONTRACT TO DO SO TO YOU FOR YOU TO SEE.. Second, the
entire time that I was employed by WFC, I was 7 days per week on 24 hour per day call
and I will submit a copy of that to you also. Third, I CHANGED THE SIDEROLLS
TWICE A DAY FOR THE ENTIRE PERIOD THAT M AND M CUSTOM FARMING
WAS EMPLOYED BY WFC AND WE NEVER MISSED ONE DAY OF WORK
EXCEPT WHEN WFC SENT US HOME OR DID NOT WANT US THERE BECAUSE
OF DRMS SHOWING UP. Brent Spangler worked for me for 7 years and never took
off a day of work for any reason other than the mine sending us home for rainy days or
for the DRMS showing up so they did not want us there. We worked all holidays and
everyday, it did not matter. We were there and we changed the water twice a day
everyday. So, when Ross provided NRCS with that information, they designed a system
for just one time a day for the side rolls to be changed. This changes the entire system
