The required fee of $257.00 for
the renewal of this substitute supply plan have been submitted (receipt no. 3642426).
Plan Operation
The mining plan includes a slurry wall around the perimeter of the site during mining. The
slurry wall has been completed; however, tests have indicated that there is a leak in the liner. The
owner of the 124 Estates Pit, is currently working to fix the slurry wall and anticipates that the
slurry wall liner will be fixed and approved prior to April 30, 2010.
The mining operations are anticipated to conclude in December 2009. This plan will
replace all lagged depletions to the river that result from the mining operations. Based on the
SWSP request, all such depletions will accrue to the stream by December 31, 2010.
All mining will be accomplished using a dry mining method. The plan includes a dewatering
trench with an exposed surface area of 2 acres. Other consumptive uses at the site include dust
control and water removed in product.
A portion of the water pumped from the dewatering trench will be discharged into the
Henderson Water Ski Lake ( "Ski Lake "), a reclaimed and unlined gravel pit. Evaporative losses
from the Ski Lake are augmented under Division 1 Water Court case no. 82CW393. According to
the plan, based on site observations of the Ski Lake, no significant increase in evaporation will
occur from the lake as a result of discharging water to the Ski Lake. The Applicant anticipates that
the Ski Lake will not have an adequate capacity to allow all of the dewatered water to be
discharged to the Ski Lake. Therefore, a portion of the water pumped from the dewatering trench
will also be delivered directly back to the stream.
Office of the State Enheer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 -866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
