DEPAR TMENT OF NATURAL RESOURCES
.M
DIVISION OF WATER RESOURCES
December 16, 2009
Bill Ritter, Jr.
Governor
James B. Martin
Executive Director
Dick Wolfe, P.E.
Director/State Engineer
(r. Jared Dains, E.I.
Applegate Group, Inc.
1499 West 120 Avenue, Suite 200
Denver, Colorado 80234 -2759
Re: 2010 Substitute Water Supply Plan (WDID 0302524)
Loloff Pit, Division of Reclamation Mining and Safety No. M -85 -112
SE' /4 NW' /4, Section 4, T5N, R65W, 6" PM
Water Division 1, Water District 3
Period of Approval: January 1, 2010 to December 31, 2010
Contact phone number for Mr. Jared Dains: 303 - 452 -6611
Dear Mr. Dains:
DEC -.
n C 6
We have reviewed your letter of November 17, 2009 requesting renewal of the above
referenced substitute water supply plan ( "SWSP ") to replace depletions that result from mining
activities. This site was previously covered under the combined SWSP for Aggregate Industries
("Al" or "Applicant ") however in 2007 the site went back to the landowner, Loloff Construction,
Inc. The required fee of $257 has been received (receipt no. 3643495).
SWSP Operations
The Loloff Pit (WDID 0303012) is located in the SE1 /4 of the NW1 /4 of Section 4,
Township 5 North, Range 65 West in Weld County. This SWSP will make replacements to the
Poudre River for 2010 and accounts for lagged depletions from past and proposed mining
operations at the Loloff Pit. As identified in the previous plan, the site was supposed to be
dewatered from March through October period and the dewatering pumps will be turned off
during the winter. months (November through February) at which time the mined area will fill with
water. Due to poor economic conditions and the additional net depletions at this site as the
result of the filling the pit, the pit operator did not dewater or mine as planned. Instead the ponds
remain full during the entire year and no mining occurred. The operator does not anticipate that
the site will be dewatered or mined below the water table in 2010, so the depletions at the site
during the period of this SWSP will result only from evaporation and dust control. The
replacement sources proposed for this operation include water leased from the Platte River
Power Authority and Graham Drainage Ditch Company.
Depletions
The current exposed ground water at the Loloff Pit site is 7.2 acres, which is estimated
to remain the same during the period of this SWSP. The estimated consumptive uses at the site
during this plan period are:
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303- 866 -3589
www.water.state.co.us
