This office acknowledges that United
Companies is the onsite operator of the gravel pit, and it is appropriate that they may be included in the correction of
the problems noted. DRMS appreciates the coordination between the two companies regarding the correction of the
problems, but until the permit is transferred, Varra Companies is still the sole permittee of the site and is the party
ultimately responsible for problem correction under this permit.
Prior to receiving your letter, we received a letter from Varra Companies authorizing United Companies to act on their
behalf in the context of correcting the problems at the site. Their letter stated that some of the problems may already
be corrected, but deferred to United Companies to provide documentation of such.
Today is the correction date, and we have not received any information showing that the problems are corrected. Your
letter, however, requests additional time to inspect the site and ensure that the required corrective actions are
implemented. Your request for an extension until January 20, 2010, is hereby approved To ensure timely
performance of the required activities, I suggest that we copy Varra Companies on future correspondence related to
problem corrections and other permit compliance issues during this period.
Thank you for United Companies' involvement with resolving problems at the site. Correspondence may be sent to
me at the Division's Durango field office: 691 CR 233, Room A -2, Durango, CO 81301; telephone 970 - 247 -5193.
Sincerely,
Bob Oswald
Environmental Protection Specialist
Cc: Garrett Varra, Varra Companies, 8120 Gage Street, Frederick, CO 80516
Ec: Steve Shuey, DRMS
(c: \09 -12 docs \seahorse west.pb corr united ext appr /rco)
Office of Office of
Mined Land Reclamation Denver • Grand Junct Dura ngo Active and Inactiv M ines
