Shamrell Blvd. <br />Suite 110 <br />Flagstaff, AZ 86001 <br />928 913-9205 <br />Re: Peabody Sage Creek Mine (C-2009-087) Request for Extension of the Preliminary <br />Adequacy Review Comment Period <br />Dear Mr. Kaldenbach: <br />Sage Creek Coal Company (SCCC) is in the process of completing its responses to the <br />Preliminary Adequacy Review for the Peabody Sage Creek Mine (PSCM) Permit Application <br />issued by the Division on August 28, 2009. As anticipated, the level of effort and time <br />necessary to complete a thorough response to adequacy comments while incorporating major <br />revisions to the permit application package (PAP) has been significant. Changes in the mine and <br />operations plan and the revision to the portal and mine facilities area have been significant as has <br />the revised analysis and update of the hydrology information. It appears all of the maps in the <br />PAP will also need to be revised in varying detail and a number of new maps have been added. <br />In order to assemble and review the revised PAP and complete responses to the PAR comments <br />that provide CDRMS sufficient review time, SCCC requests that the deadline for issuing a <br />proposed decision for the PSCM be extended to February 15, 2010. <br />If you have any questions or need additional information regarding this request, please contact <br />me as soon as possible. <br />Sincerely, <br />Vern Pfannens iel <br />Manager Environmental Services - West <br />Peabody Investments Corporation <br />cc: Brian Dunfee (PEC) <br />Jerry Nettleton (TMCC)
