IIIS-11 ko/
CERTIFIED MAIL
RETURN RECEIPT NO. 7007 0710 0001 1498 2591
December 8, 2009
cINvS°
,E,C 0 9 2009
DivAion of Reclamation
Mining and Safety
i A&
Mr. Tony Waldron A AGGREGATE
Division of Reclamation, Mining & Safety INDUSTRIES
1313 Sherman Street, Room 215
Denver, CO 80203 /
Re: Permit No. M- 1999 -021- Stegner Farms — Financial Warranty Reduction Request
Dear Mr. Waldron:
In accordance with Constriction Materials Rules 4.14 and 4.17, Aggregate Industries submits this letter
as a request for a reduction of the financial warranty for the above - referenced permit. The current bond
amount if $273,400. Of that amount, $94,300 is associated with TR -1 for the slurry wall constructed
around the pit. Following completion of Aggregate's extraction activity and reservoir slope construction
in November, 2009, a pit liner leak test was conducted, and the Division of Water Resources (DWR)
approved the lining of the gravel pit based upon the leak test results. A copy of DWR's verification letter,
dated March 23, 2009, is enclosed herewith.
As noted above, Aggregate has also completed the slopes of the reservoir. Additionally, backfilling and
grading of the remainder of the site has been completed in substantial conformance with the reclamation
design sett forth in TR-4, although the land and pond features have been slightly reconfigured in
accordance with the land owner's direction. Reclamation activities remaining to be completed include
topsoil application, final grading and seeding. We estimate these costs to be approximately $40,000 and
therefore: request reduction of the financial warranty to said $40,000.
This site is currently owned by Trollco, Inc.
