The affidavit of Publication has been previously submitted per our conversation <br />on November 30, 2009. <br />2. The maps were signed in your office on November 30, 2009. <br />3. The statement of no explosives being used is in the second to last paragraph in <br />exhibit D. <br />4. While not in the adequacy review comments Exhibit D has been modified to <br />update the USFS appeal process on the FONSI ROD. The USFS review team <br />upheld the District Ranger's decision. The appeals and appeal review decision <br />correspondence are included in Exhibit D now. Also the 5 ton flatbed truck is a <br />15 ton flatbed. <br />5. Exhibit E has been revised to include the language from the EA and FONSI ROD <br />concerning rock staining and when it would be done. The operator has proposed <br />three alternatives to address the darkening of light rock areas that are to be used <br />before rock staining. <br />6. It is our understanding the reclamation bond estimate does not need to include <br />rock staining at this time since alternative mitigations have been proposed. It is <br />anticipated that the preferred method of using unusable surface rock to cover the <br />lighter rock can be included in the bond as rough grading. <br />7. Gary Woodworth, Gallegos Corporation, confirmed with Glen Gallegos that he <br />owns the house at the base of the hill and therefore would not be subject to <br />waivers or site stability analysis.
