Cattany <br />Division Director <br />Natural Resource Trustee <br />OCT 2 6..2009 <br />DiviO <br />MWng and Sate <br />In previous correspondences, dated August 3 and 11, 2009, the Division requested that you provide <br />written confirmation for the official address for Wildcat Mining Corporation (Wildcat). Our records <br />indicate the official address for Wildcat is 3643 Baker Street, San Diego, California 92117. Such address is <br />confirmed by the Colorado Secretary of State web site. However, search results from the US Postal <br />Service web site indicate that the US Postal Service is forwarding mail for Wildcat to Durango, Colorado. <br />Apparently, Wildcat has changed its address with the US Postal Service but has not provided official notice <br />of such change to the Division of Reclamation, Mining and Safety or to the Colorado Secretary of State. <br />Pursuant to Rule 1.16(1), it shall be the duty of the Operator to keep the Office notified of any mailing <br />address change by promptly sending written notice of such change to the Office. The Office is entitled to <br />assume, in the absence of such notice, that it may proceed with the last previous address provided by the <br />Operator, and the Operator will be bound by such Notice as if actually received. <br />On October 2, 2009, the Division mailed two notices by Certified Mail to Wildcat's official address in San <br />Diego. The notices informed Wildcat that the Division had reason to believe that two violations existed at <br />the May Day Mine and that the violations were scheduled for consideration by the Mined Land <br />Reclamation Board (Board) during the November 12-13, 2009 Board meeting. On October 5, 2009, the <br />Division mailed a notice by Certified Mail to Wildcat's official address in San Diego. This third notice <br />informed Wildcat that the Division had reason to believe that a violation existed at the Idaho Mill and that <br />the violation was scheduled for consideration by the Board during the November 12-13, 2009 Board <br />meeting. The three notices were mailed Certified Mail, return receipt requested, in accordance with the <br />requirements of Rules 3.2(4), 3.3.1 and 3.3.2. <br />According to the US Postal Service web site, you have claimed only one of the three notices.
