RE: Bromley Lakes Pit, DRMS file #: M=1987-049, Division's Recommendation for Approval of the
Amendment Application.
Dear Mr. Spratlen:
In accordance with Rule 1.4.9 (2) (c), the Division is required to submit a recommendation of approval
or denial of an application where an objection has been raised to the Mine Land Reclamation Board.
Also, the Division is required to send its recommendation to the applicant and the objector at least
three working days prior to the Pre-Hearing Conference. Enclosed with this letter is the Division's
rational for their recommendation for approval of the application over the objection.
As you know, the Pre-hearing Conference.has been re-scheduled to.occur on October 29th, 2009
beginning at 1:00 p.m. The conference will occur at 1313 Sherman Street,.Denver, Colorado in Room
221.
Please remember, Failure to participate in the Prehearing Conference will. result in the loss of Vour
party status.
The purpose of the Pre-hearing Conference is to describe the Office's rev.iew process, to explain the
rights and responsibilities of parties, to discuss and resolve issues to the extent possible, to describe
the Board Hearing processes, to determine the list of issues under the Board's jurisdiction and to
simplify the list, and to determine who has demonstrated standing to be a party to the Formal Board
Hearing. Please note, pursuant to Rule 2.6 (2), parties are required to provide thirteen (13) 3-hole
punched copies of their list of potential witnesses and their exhibits at the Pre-Hearing Conference.
Failure to do so may'preclude use of witness testimony or exhibits at the Formal Public Hearing.
