Brown, dandy <br />aub??t: Landowner contact <br />Dear Rossr <br />I received a telephone call this morning from dirk Richards, who is one of the landowners at the New Horizon Mine As <br />you are aware, his parcel lies earth of BB Raad to the northeastern corner of the permit area Mr. Richards purchased the <br />property from Mr. Martin, the original landowner, <br />Mr. Richards called me to discuss reclamation of the BB Detour Raad He stated that vVestern Fuels has informed him <br />that the Division is requiring vUFC to reclaim the portion of the Detour that is an his land. He wondered, if that is sa, why <br />the Division is allowing the portion of the Detour that lies an Benson's land immediately west of Richards' praperky} to be <br />left in place. Mr. Richards communicated to nee that he would prefer to keep the segment of the Detour that crosses his <br />property. <br />I informed Mr. Richards that the Division is not "requiring" vUestern Fuels to reclaim the Detour on his land, I explained <br />that the current permit prepared by the applicant and approved by the Division} states that the BB Detour will be <br />reclaimed throughout its entire length, but that you Ross} have indicated verbally to me during the September and <br />October 2008 inspections} that Mr. Benson wishes retain his portion of the Detour for access to his property. [I believe <br />you also stated that Mr. Richards does eat avant to keep his parkian of the Detour, and that it would be reclaimed in the <br />near future,] <br />Regarding the BB Detour Road, there is a process available that can allow it far a portion of it} to be retained <br />permanently. Please refer to the fallowing Rules; <br />? 2.5.4 -Reclamation Plan <br />2.0?,5? ?}fib} - Postmining Land uses <br />? 4??3?2?7} -? Access Rands -Reclamation <br />Any change to the currently approved reclamation plan will require a 1"echnical Revision, including a letter from the <br />landowners}stating their agreement with any proposed changes. <br />?n the separate issue of ditch?pipeline ease?nen? through his property, Mr. Richards asked how he could find vat where <br />the ditch originally ran, prior to mining disturbance.
