Cattany <br />Division Director <br /> Natural Resource Trustee <br />RE: Elk Creek Mine, Permit No. C-1981-022, Oxbow Mining LLC <br />2008 Annual Hydrology Report, Adequacy Review <br />Dear Mr. Kiger: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its review of the 2008 Annual <br />Hydrology Report (AHR) for the Elk Creek Mine. The Division has the following questions and comments: <br />Hydrologic Monitoring <br />The hydrologic data sheet for surface water monitoring site E-2 does not show any full suite laboratory <br />data for 2008, even though the hydrologic monitoring schedule on page 5 of the 2008 AHR shows that a <br />full suite analysis is required for the 2"d and 3rd quarters, if a sample is available. Please explain. <br />2. The hydrologic data sheet for surface water monitoring site NF-1 does not show any 4th quarter 2008 <br />data for a full suite analysis, as required by the hydrologic monitoring schedule on page 5 of the 2008 <br />AHR. Please explain this omission. <br />The hydrologic data sheet for ground water monitoring site EC-14, listed as E-14 on the data sheet, does <br />not show any 3rd quarter full suite analysis for 2008, even though this is required by the hydrologic <br />monitoring schedule shown on page 5 of the 2008 AHR. Please explain this omission. <br />Compliance With Surface Water and Ground Water Standards <br />The Division's review of the 2008 AHR did not reveal any exceedences, nor any trends towards exceedances, of <br />receiving stream and ground water standards. Comparison of data from up gradient monitoring sites to that of <br />down gradient monitoring sites did not show any degradation of water quality or quantity.
