Cattany <br />Division Director <br />Dumb & Dumber Trucking Natural Resource Trustee <br />Attention: Mr. Brian Barton <br />1957 County Road 57 <br />Sterling, CO 80751 <br />Re: Barton Pit, Permit M-2000-149, Financial Warranty Increase, Revision SI-01 <br />Dear Mr. Barton: <br />On October 15, 2009 the Colorado Division of Reclamation, Mining and Safety increased the <br />current Financial Warranty for this permit to $49,000 in accordance with Rules 4.2.1 (1) and (2) <br />of the Minerals Rules and Regulations. This is an increase of $34,000 from the current financial <br />warranty. <br />Please submit a rider or a new financial warranty, within 60 days from the date of this letter (by <br />December 14, 2009). If you wish to submit a different type of Financial Warranty, the <br />application forms for the various acceptable warranty types can be found at the following <br />website: http://mining.state.co.us/Mineral%20Forms.htm . Our bonding specialist Elizabeth <br />Merry (extension 8148) will likely be able to assist you with any questions you might have with <br />regards to the process requirements. <br />If the full warranty has not been posted by December 14, 2009, you will be in violation of <br />section 34-32.5-117(6) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials which states: "A financial warranty shall be maintained in good standing for the entire <br />life of a permit issued under this article. " This violation would require a Mined Land <br />Reclamation Board (MLRB) hearing, which could result in penalties from additional fines to <br />permit forfeiture. <br />As we have discussed, this increase is a result of the current site conditions observed during the <br />June 10, 2009 inspection of the site. Almost $27,000 of this warranty increase is associated with <br />the reclamation of the large high-wall which now exists on the site, and is not part of the current <br />approved mining plan. If this high-wall is resloped to no steeper than 3:1 slopes within the <br />allotted 60 days, this portion of the warranty increase may be removed. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
