The Perry Pit was originally permitted <br />in 1990 with an Amendment approved in 2001. The Amendment created water <br />storage as the post-mining land use and combined what were two ponds into <br />one. <br />After the approval of the 2001 Amendment, Asphalt Paving Company made <br />application to the U.S. Army Corps of Engineers for an individual 404 permit. <br />This was necessary due to some wetlands disturbance resulting from mining. <br />The Corps required that the Lupton Bottoms Ditch be rerouted around the pond <br />to the west and that the relocated ditch be planted with native wetland <br />vegetation. This has been successfully done. As a result, when you performed <br />your recent site inspection the ditch was not located as shown in the 2001 <br />exhibits. The reason for this Technical Revision is to ensure that your records <br />accurately reflect the current location of the ditch. <br />Attached to this letter is a revised Exhibit F, Reclamation Plan, showing the <br />correct alignment of the relocated Lupton Bottoms Ditch. There is also a minor <br />reconfiguration of the pit limits that was done to accommodate the ditch.
