Cattany <br />Paining and Safety Division Director <br /> Natural Resource Trustee <br />Re: J-Bird Mine, File No. M-2005-050, Receipt of 110d, Hard Rock/Metal Mining Reclamation <br />Permit Amendment Application Package, Complete for Review. 14M_ 01 <br />Dear Ms. Garrigues: <br />On August 28, 2009, the Division of Reclamation, Mining and Safety received your 110d Hard Rock/Metal Mining <br />Reclamation Permit Amendment Application package for the J-Bird Mine, File No. M-2005-050. The amendment is the <br />submittal of an Environmental Protection Plan required for all Designated Mining Operations (DMO) permits. Gault <br />Group and Rimrock Mining were notified on September 2, 2009 that the application was considered incomplete. On <br />September 28, 2009 Gault Group and Rimrock resubmitted the amendment application. Staff review indicates the <br />application appears to be complete for review and is considered filed. Based on the amount of information for water, <br />geo-chemical analysis and engineering that is required for a DMO, the Division is calling the application complex. The <br />complex designation allows the Division an additional 60 days beyond the normal 30 for a normal 110d permit per Rule <br />1.4.1(7). Therefore the Decision Date for this application is set for 90 days from the date of this letter which is January <br />4, 2010. <br />Per Rule 1.6.2 General Applicant Procedures: <br />(d) Within ten (10) days after the Office notifies the Applicant that the application is considered filed, publish a public <br />notice in a newspaper of general circulation in the locality of the proposed mining operation containing: <br />(i) name and address of Applicant; <br />(ii) location of the proposed mining operation by section, township and range and street address where applicable; <br />(iii) proposed dates of commencement and completion of the operation; <br />(iv) proposed future use of affected land; <br />(v) location where additional information on the operation may be obtained; and <br />(vi) location and final date for submitting statements of support or objections with the Office. For a 110d the <br />comment period is ten (10) days from date of publication. <br />Please begin publication within 10 days of this letter and provide the date of publication to the Division so that the <br />comment period can be noted as part of the review process.
