Below is <br />Mr. Reese's response to items that were noted as needing attention. <br />Investigation Items <br />Hydrologic Balance - Mr. Reese has applied for a Substitute Water Supply Plan (SWSP) <br />for 2009 through 2010 to come into compliance with augmentation requirements <br />pursuant to §37-90-137(11)(a)(11). The SWSP is under review by the Office of the State <br />Engineer. The SWSP addresses all concerns relative to a hydrologic balance resulting <br />from mining operations, including water retained in product, free water surface <br />evaporation from open mine pits and swamp areas, monthly accounting and replacement <br />sources. Enclosed is the 2009-2010 SWSP submitted to the Office of the State Engineer. <br />In addition, Mr. Reese is actively pursuing inclusion into the Logan Well Users <br />Augmentation Plan, 03CW195. This will be a permanent augmentation supply for all <br />future evaporative and mining operational depletions associated with the mine. The <br />Logan Well Users will amend its decree at the end of 2009 and include Mr. Reese's mine <br />and associated obligations. <br />2. Also enclosed is the application for an amended 110 permit. This amendment was <br />prepared to address up-dates to the mining plan relative to exposed water from mining <br />operations and new reclamation plans.
