Cattany <br />Division Director <br />Natural Resource Trustee <br />On September 2, 2009, the Colorado Division of Reclamation, Mining and Safety (the Division) determined <br />that the above referenced request was complete for the purposes of filing. The review period for SL-01 <br />commenced on September 2, 2009, and pursuant to Rule 4.17.2(2) the Division will inspect the site no <br />later than November 1, 2009, and will shortly thereafter inform you of its decision on SL-01. <br />Permit documents indicate that the excavation activity would expose ground water and a well permit, <br />through the Office of the State Engineer, Division of Water Resources, was required and would be <br />acquired. Pursuant to Rule 3.1.6(1)(a), the Operator is required to comply with Colorado water laws and <br />regulations governing injury to existing water rights. Please demonstrate compliance with permit <br />conditions and Rule 3.1.6(1)(a) by submitting copy of a valid well permit for the existing pond created by <br />the mining and reclamation activities.
