Rubey Drive, Suite 201 Division Director <br /> <br />Golden, CO 80402 Natural Resource Trustee <br />Re: Notice of Intent P-2009-025, Adequacy Review. <br />Dear Mr. Valerrine: <br />The Division has reviewed your Notice of Intent to Conduct Prospecting Operations in Fremont county <br />and has the following adequacy comments. <br />1) The operator plans to conduct 5 to 10% of the prospecting activity within 200 feet of the stream. <br />The average depth of these holes is going to be approximately 650 feet. Even though the <br />probability of affecting the flow is minimal, since you are going to be deeper than the base <br />elevation of the channel, all holes drilled within 200 feet of the channel must be backfilled the <br />entire depth of the holes with bentonite or cement. Please commit to this requirement in you <br />response. <br />2) Please provide a more specific location map for the public file. <br />3) Please commit to sampling the mud pit contents and providing a complete suite analysis for <br />metals for all of the mud pits included in this NOI along with an analysis for Uranium, Radium <br />226 and Radium 228. <br />The following stipulation applies to the above testing requirement. <br />Stipulation No.1 <br />The contents and cover of the backfilled mud spits will not exceed the following limits: <br />1. The Concentration of radium 226 or (radium 228 may not exceed the background <br />level by more than 5 picocuries per gram (pCi/g)or 0.185 becquerels per gram <br />(Bq/g)• <br />2. The Concentration of natural uranium with no radioactive decay products present <br />may not exceed the background level by more than 30 p(Ci/g) or 1.11 Bq/g, and 150 <br />pCi/g or 5.55 Bq/g, so that no individual member of the public will receive an <br />effective dose equivalent in excess of 100rem per year or 1 millisevert (mSv) per <br />year. <br />4) Item # 5 on page. 4 states "A maximum of 50 drill pads will be constructed, item # 6"Proposed <br />disturbances" shows a total of 25 drill pads.
