Preliminary Adequacy Review of Permit Application
Dear Mr. Pfannenstiel:
The Division has conducted a preliminary technical adequacy review of the mining and
reclamation permit application submitted by Sage Creek Coal Company (SCCC) for the
proposed Peabody Sage Creek Mine (PSCM). The Division appreciates the high level
of detail and excellent organization of the submittal. Our adequacy comments are
provided below.
Please provide responses to our comments so that we may complete our adequacy
review by the deadline for issuing a proposed decision, October 28, 2009. If additional
time is needed for responding and our subsequent review, then you may request an
extension of the decision deadline.
Section 2.03.4
1. On page 2.03-9, under 2.03.4(2)(a) please update the Employer ID number for
Sage Creek Coal Company, LLC. It is listed on the ownership and control sheet
in Exhibit 2.03.4-E3.
2. On page 2.03-10, under 2.03.4(3), please update the paragraph to take out the
following "... , which is owned by Peabody Operations Holding, LLC, ..." .
By AVS and the ownership and control information, along with the Peabody
Organizational Chart submitted in Exhibit 2.03.4-E4, Peabody Operations
Holding, LLC is a not an owner of Peabody Colorado Operations, LLC.
