Letter dated August 4, 2009
Mr. Hays,
The purpose of this letter is to provide you with response to the comments from the August 4, 2009 2nd
Adequacy Review Letter. The following are responses to each comment:
1. Comment: As required by Rule 1.6.2(1)(e), please submit proof of public notice circulated to all owners of
record of surface lands, mineral rights and easement holders that are on the affected land and within 200
feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or
by proof of personal service.
Please provide proof of notice to the following owners of record of surface and mineral rights:
a. Camilletti and Sons, Inc.
b. State of Colorado Board of Land Commissioners
Response: Attached are signed and notarized letters from Camilletti and Sons, Inc. and the State of
Colorado Board of Land Commissioners acknowledging that both are aware of the Amendment
Application and their agreement to waive the 20 day comment period for the Amendment
Application.
2. Comment: The applicant supplied the Division with a copy of the "Revised Reclamation Plan for the
Camilletti Milner Pit #2 Gravel Mine" by IME dated July 23, 2001. The Revised Reclamation Plan is not
consistent with the approved Reclamation Plan dated June 12, 2001 on file with the Division. The
Division recommends the Operator submit a technical revision to the permit, including the required $216
fee, to update the Reclamation Plan for the site.
Response: Attached is a signed and notarized letter from Precision Excavating, Inc. documenting
the technical revision to the Camilletti Milner Pit #2 (#M-2001-023) to updated the Reclamation Plan
per the "Revised Reclamation Plan for the Camilletti Milner Pit #2 Gravel Mine" by IME dated July
23, 2001. Also included is the required check for the $216 fee to update the Reclamation Plan.
Rule 6.4.13 Exhibit M - Other Permits and Licenses
3. Comment: Please commit to providing the Division with a copy of the approved Weed Control
Management Plan approved by the Routt County Extension Office for the Camilletti Milner Pit #2
amendment area.
Response: The Operator commits to providing the Division with a copy of the approved Weed
Control Management Plan.
Rule 6.4.14 Exhibit N - Source of Legal Right to Enter
4. Comment: The letter dated July 15, 2009 from Ed Camilletti authorizing Precision Excavating to mine
gravel was not notarized and the location, NEIANW1/4 Section 22, is not consistent with the legal
description indicated on the application form or Exhibit A. Per Rule 6.3.7, please provide a description of
