RE: NCCI Pit #1, Permit No. M-2001-107, List of Events Establishing Bond
Requirements Since The Issuing Of the Mining Permit
Dear Mr. Cunningham:
Following is a list of events that have been established concerning phase bonding for the above
described mining permit.
• January 2, 2003 - Letter from Mr. Thomas A. Schreiner with approval of Revision No.
TR-2 for Phased bonding of 7 phases and establishing a bonding amount for each of the 7
phases approved. Also, a request to submit a financial warranty for phase No.1 in the
amount of $249,900.00. (See Attached Letter)
• Copy of the NCCI mining plat identifying Phases No. 1 thru No. 7.
• February 2, 2003 NCCI submitted a financial warranty bond issued by Travelers
Insurance, Bond No. 103915605 in the amount of $249,937.00
• August 4, 2006 - Letter from Douglas D. Graff, NCCI to Mr. Thomas A. Schreiner with
four (4) additional financial warrantee bonds for Phase No. 2, No. 3, No. 4 and Phase No.
5. Traveler Insurance Bond No. 104719918 in the amount of $168,000.00, Bond No.
104719919 in the amount of $256,000.00, Bond No. 104719920 in the amount of
$286,500.00 and Bond No. 104719921 in the amount of $182,600.00. (see attached copy
of the letter)
• Total Bonding amount in place as of August 4, 2006 was $1,143,037.00.
• January 4, 2007 - Letter from Erica S. Crosby with approval of Technical Revision No.
TR-3 and establishing new financial warranty for the site in the amount of $767,983.00.
(See attached letter).
• January 8, 2008 - Letter from Mr. David A. Bird with approval of Amendment Approval,
Revision No. AM-1. This added 72.86 acres to the original permit and approved Phases
1 thru 13 for phased bonding. The total financial warranty amount of $1,338,509.00 was
approved with $767,983.00 being required to cover Technical Revision No. TR-3.
Additionally, NCCI would need to increase our financial warranty by $180,008.00 within
365 days of the date of approval or upon initiation of mining in the expanded area,
