Cattany <br />Division Director <br />Natural Resource <br />Trustee <br />RE: File No. M-1996-049; Maryland Creek Ranch; Technical Revision 05 -Increase Affected Acreage <br />Within the Existing Permit Area, submitted by Everist Materials, LLC <br />Dear Mr. Blaylock: <br />The Division of Reclamation, Mining and Safety (DRMS) has received your request for a Technical Revision <br />JR) for the Maryland Creek Ranch Site to increase the affected mining area within the existing permitted area. <br />The revision was received on May 6, 2009 and called complete for review on that date. <br />According to 34-32.5-112 (7)(a) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials, an increase in affected area within an existing permit requires a permit amendment, not a technical <br />revision. Everist may withdraw the request to add additional affected acreage under a TR within 30 days and <br />the TR fee of $216.00 will be returned. Otherwise, at the end of 30 days (June 5, 2009) the TR will be denied <br />by rule, and the fee will not be refunded. <br />If Everist wishes to submit an application for a permit amendment to increase the affected acreage, please refer <br />to Section 1.10 - Amendment to a Permit in the Construction Materials Rule for the required procedure and <br />fees.
