Cattany <br />Division Director <br />720 Kipling St. Suite 117 Natural Resource Trustee <br />Lakewood, Colorado 80215 <br />Re: Dick Casey Concrete Pit, Permit No. M-1978-349, Technical Revision, TR-03, Initial Review. <br />Dear Mr. Schatz, <br />The Division of Reclamation Mining and Safety (DRMS) has reviewed Dick Casey Concrete's request for a <br />technical revision to the above referenced permitted site. While staff has no issue with the changes in <br />plans for both mining and final reclamation one issue must be thoroughly addressed prior to any <br />approvals. A review of the file notes that TR-02 for this site which was approved on February 2, 2007. <br />TR-02 was for the removal of the land bridge between the Dick Casey Pit and the Chambers Pit, M-1979- <br />205. At that time documentation was submitted that showed there was sufficient room under the site <br />augmentation plans for that revision. There is 23 acres of augmentation approved and at the time only <br />17 acres of exposed water all or most of which was is tied to the Chambers Pit not the Casey. The <br />current TR-03 for the Dick Casey Concrete Pit shows approximately 22 acres of water to be exposed. <br />The Division is requesting a full accounting of exposed water surfaces and the approved augmentation <br />plans to support the exposure of that ground water within the permit area per Rule 3.1.6(a). If the land <br />bridge has been removed per TR-02 then those waters from the Chambers Pit (M-1979-205) must be <br />accounted for as well one way or another. Please find enclose a memo sent out by the Office of State <br />Engineer regarding administration of exposed ground water for pits operating prior to and after January <br />1, 1981. This may be of assistance in the water balance considerations given United/ Old Castle owns all <br />adjacent pits. <br />The Decision Date by rule was set for May 15, 2009. Based on the complexity of the water issue it may <br />not be possible for the operator to gather the required information and have it submitted in time for <br />proper review by staff. If the information cannot be submitted by May 11, 2009 then the operator <br />should request an extension of the decision date with enough time to allow for gathering of all <br />information and sufficient division review time. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
