Y <br />Re: M-2005-009 TR03, response to adequacy review letter dated March 18,'2009 <br />Dear Mr. Scott. <br />Asphait Specialties Co., Inc. (ASCI) has contracted Weiland Iric. (W!) to assist in the <br />preparation of the TR03 permit documents.. This letter responds to each of the bullet <br />items given in the letter dated March, 18 2009 from the Colorado Division of Mining <br />Redar9ation & Safety (CDRMS) toASCL Each.bullet item from the CDRMS letter.is . <br />given below and is followed a response in bold italics. <br />It appears that at least one undergrpund gas line and one ur,dercrcund electric <br />line will need to be relocated near the south and to Call 1. ,Are agreements <br />a"ready in place with the appropriate utilities for the rc.lcCatic?? of :hose lines? <br />A+c o, no costs for the relocation of the:3e lines hove t n nr. tided in the cost <br />„e stirrrate as submitted. <br />The line ,filar; has been edited to specify that approximately S81 linear ft of oil & <br />gas flowline is to be relocated in the south of Cell 1. A s4rfaice •use agreement has <br />been executed between ASCI and the oil & gas operators on the property, which <br />in a provision for relocation. The section of the SUA, that pertains to. <br />flowline relocation has been'included in this submittal. Additionally, this task has <br />been added to the mine plan (Exhibit D) and costs have been assigned to thin <br />work and are included in the revised Exhibit L. With regard to the underground . <br />electric line shown on the previous TR03 submittal, it is understood that this <br />electric line is no longer in service and so it has been removed from Exhibit C-2, <br />Sheet 1 and Exhibit F Sheet 9. <br />• The feasibility study as submitted does not contain some of the required <br />information (such as material mixing specifications, liner cover. specifications, . <br />QA/QC protocol, etc) and commitments to be eligible f6i, the reduced bond <br />option,. It may be helpful to review pages 8.through 13 of the "GUIDE TO. <br />SPECIFICATION PREPARATION FOR.SLURRY WALLS AND CLAY LINERS <br />AS A COMPONENT OF A COLORADO MINED LAND RECLAMATION <br />PERMIT" (available on the DRMS website) for a more complete listing of <br />specifications and commitments required for the reduced bond option.
