December 26, 2007
Division of Reclamation, Mining, and Safety
1313 Sherman Street
Room 215
Denver, Colorado 80203
JAN 0 f?
GR'9NOjuivrr/`92008
-C?",-?'TO/?S?N?FLV aFF/
. `'vp?l,?7AjG& CF
Re: Technical Revision to the New Horizon Mine Permit No. C-81-008 by Western
Fuels-Colorado (WFC) in Nucla, Co.
-TU,s?
We are writing this letter as a formal protest to the application for a Technical Revision
to the New Horizon Mine Permit No. C-81-008. The Technical Revision is to Section
2.05.4(2)e. This is also an objection to the renewal of the existing permit until all questions
are satisfied.
I,-Frank Morgan, went to the court house to see if I could have them make me a copy of
this revision. My eyesight is very bad and I need the use of my magnifying glass and good
lighting. Danelle called Ross Gubka to see if we could make a copy right there and- he
refused. A lot of the property in question belongs tome. This revision is not acceptable
for many reasons. Many statements and descriptions are not accurate or true. I have farmed
my entire life and my property which is presently being mined.and some already mined
is and was prime farmland. We do not raise cattle or livestock We raise and sell alfalfa and
corn and we must have production to stay in business.
We would like to -invite you to please come and visit with just us. We would like to show you
our property which has been mined and the property about to be mined. We raise alfalfa
not pasture land. Good production here takes can of several families. We do not have other
jobs to support the ranch, the ranch must take care of itself. We raise a thousand ton or more of
alfalfa hay and corn. It was my understanding at the time of the lease that this land would be
put 'back in as good or better condition than what it was. Now, the mine is not only trying to
change the way to get bond release, but is trying to take prime farmland and call it irrigated
pasture. There is no resemblance. We spend hours and hours plowing, disking, leveling,
