During the review of that amendment <br />(AM2), discussions with Mr. Tom Schreiner of the DRMS, and submittals by MRV <br />included the proposed tailings backfill of underground workings within the Cash Mine <br />and the surrounding properties. Per our discussion with you, and after reviewing the <br />DRMS supplied permit Digital Video Disk (DVD) data, it is clear that several important <br />documents pertaining to the M1983-141, AM2 permitting are missing from the file. It is <br />in light of these missing documents, and in recognition that conflicting statements <br />regarding a proposed Technical Revision to this permit to specifically address <br />underground tailings emplacement exist within the entire document set of the AM2 and <br />TR5 permitting, that MRV believes that the best resolution of this issue would be to <br />obtain a separate Technical Revision to the permit that, in fact, unequivocally addresses <br />the issue. <br />At this time, MRV requests a Technical Revision (TR6) to the M1983-141 permit. In <br />support of the request, MRV offers the following: <br />1) Per the Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for Hard Rock, Metal and Designated Mining Operations, adopted August <br />2006, effective October 1, 2006: "Technical Revision" means a change in the <br />permit or an application, which does not have more than a minor effect upon the <br />approved or proposed Reclamation or Environmental Protection Plan (italics <br />added). MRV asserts that the addition of underground emplacement of mill <br />tailings will have no effect upon the approved Reclamation Plan. As a non-DMO <br />operation, MRV is not required to obtain, hold or maintain an approved <br />Environmental Protection Plan, however this requested Technical Revision would <br />M1983-141 TR06 Request 3-5-09.doc <br />1 of 3
