M-1999-098; Riverview Resource Preliminary Adeguacy Review Response <br />Dear Eric, <br />The following provides written responses on behalf of permit applicant Aggregate <br />Industries-WCR, Inc. (AI) as a follow up to your comments of March 11, 2009, and our <br />meeting on Monday afternoon. <br />6.4.3 EXHIBIT C - Pre-minina and Minina Plan Maps) of Affected Lands <br />Updated plans that include the new gas metering structures and associated easements, <br />located at the northwest corner of Cell 4 are attached. The new facilities belong to Kinder <br />Morgan and are located north and west of the existing gas well, adjacent to the railroad <br />right of way. They are not located within 200' of the affected area and will not impact the <br />configuration of the mining cell in that area. <br />6.4.6 EXHIBIT F - Reclamation Plan Map <br />The gas meter station easement is shown on the attached updated Reclamation Plan Map. <br />6.4.12 EXHIBIT L - Reclamation Costs <br />Mining activity within the amendment area will not commence until the market demands <br />require expansion of the existing operation. The amendment area will be mined and <br />reclaimed in phases. Per Rule 4.2.1 (4) Aggregate Industries WCR, Inc. (AI) requests <br />that the Division approve this permit amendment with the express understanding that no <br />mining activities will take place within the amendment areas until the Division has <br />evaluated and AI has posted required bonding for the initial phase of mining within the <br />amendment area. AI will contact the Division and provide specific quantities for the first <br />phase of mining so the Division can determine the bonding requirements. <br />6.4.17 EXHIBIT Q - Proof of Mailing of Notices to County Commissioners and <br />Soil Conservation District <br />We sent copies of the March 10, 2009 adequacy comment response as required. Receipts <br />for the delivery are attached.
