ALBERT FRET & SONS

March 11, 2009
Mr. Tony Waldron
Division of Reclamation, Mining & Safety
Minerals Section
1313 Sherman Street Suite 215
Denver, Colorado 80203-2273
Dear Mr. Waldron:
Re: Annual Report, Worthing Pit
M.L.R.B. Permit No. M-77-526

P.O. BOX 700
HENDERSON, CO 80640
(303) 289-1837
(303) 289-2865 FAX

DI?1i i 1. :' r
Our files indicate that the anniversary date for this permit
is March 28, 2009. The effective date of all information in this
report is March 4, 2009. Please refer to the attached Annual
Report Map for the location of areas discussed in this report.
This pit HAS NOT been granted a Temporary Cessation and it HAS
operated more than 180 days this year. This permit was amended in
2006 to add construction of a slurry wall to the permit and the
current bond is $494,300.00.
We will deal specifically with each of the Annual Report
requirements as outlined in Rule 1.15 of the Rules and Regulations.
(1) We continued to remove material stockpiled in previous years
and mine material from the bottom of the northern lake areas.
No new areas we disturbed.
(2) Backfilling has continued on the southern mined area where we
moved the tailing pond (10.11 acres ±). We also began back-
filled an area in the northeast corner of the southern area to
its final grade (2.08 acres). Eventually the remaining 6.62
acres will be backfilled as approved. Two area on north area
have been backfilled. The eastern part of the tailing pond
has been filled to the same level as the residential area
(4.24 ac.) and slope backfilling began in the north part of
the mining area (1.31 ac.). Since most of the mining area is
dewatered the lake now covers 32.84 acres ± of the disturbed
area.
(3) We will continue to mine in the northeast lake area and once
the material is gone we will move to the southern most end of
the permit area just north of the slurry wall and begin mining
to the north (13.54 ac.).
