Cattany <br />Division Director <br />Natural Resource Trustee <br />NOTICE OF PROPOSED DECISION <br />The 'Colorado Division of Reclamation, Mining and Safety proposes to <br />Approye Permit-, Renewal Application No. 5 (RN-5), submitted by New <br />Elk Coal Company, LLC for a coal mining permit at the New Elk Mine <br />(Permit No. C-1981-012). The proposed renewal will allow for continued <br />mining and/or reclamation operations at the site. <br />The New Elk Mine is located in Las Animas County, approximately 25 <br />miles west of Trinidad, Colorado, Colorado. Coal interest at this under- <br />ground mine is Private, and the surface to be affected is Private land. <br />The permit area encompasses approximately 900.00 acres. <br />This proposed decision is based on a finding that the proposed opera- <br />tion will comply with all requirements of the Colorado Surface Coal Min- <br />ing Reclamation Act, Section 34-33-101 et seq., C.R.S., and the regula- <br />tions promulgated thereunder. <br />A copy of the "Proposed Decision and Findings of Compliance", includ- <br />ing any stipulations, is on file for public inspection at the Colorado Divi- <br />sion of Reclamation, Mining and Safety, Room 215 Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203, and at the Las Animas <br />County Clerk's Office, 200 East First Street, Room 104, Trinidad, CO <br />81082. Persons with an interest that may be adversely affected by the <br />proposed. decision may request a formal hearing before the Mi"901and <br />Reclamation Board on the proposed decision.
