Sherman
Executive Director
Dick Wolfe, P.E.
Director
CONDITIONS FOR APPROVAL
Connell Resources, Inc., requested full reclamation responsibility release for the Wellington
Downs Pit, Permit no. M-1995-035.
By letter dated January 12, 2009, the Applicant's consultant, Applegate Group, Inc., provided
additional information regarding the replacement of lagged stream depletions. According to
the information provided by Applegate, the lagged stream depletions resulting from past
operations at the Wellington Downs Pit have been replaced using recharge accretions. The
schedule of lagged stream depletions and the corresponding replacements from recharge
accretions indicated that all lagged stream depletions would end as of March 2009.
Accordingly, we believe Applicant has adequately shown that lagged stream depletions have
been replaced and we recommend approval of the request for full reclamation responsibility
release.
The applicant may contact the State Engineer's Office with any questions.
RECEIVED
,"FEB [06uj
Cc: Richard Raines, Applegate Group .14,0 D'w sk)nOt tteCmmauon,
ana sategr
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone; 303866-3581 • Fax: $03-866-3589
www.water.state.co.us
