Cattany <br />, Division Director <br /> Natural Resource Trustee <br />RE: Trapper Mining, Inc., Permit C-81-010 <br />Forth Quarter 2008 Discharge Monitoring Reports Review <br />Dear Mr. Roberts, <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) has reviewed and found the <br />above referenced report to be in compliance with Rule 4.05.13(2). The Forth Quarter Discharge <br />Monitoring Reports were received by the Division on 29 January 2009. The reports cover the time <br />period from 01 October 2008 through 31 December 2008. <br />Five NPDES outfalls discharged during the Forth Quarter of 2008. Outfall 011 discharged in response <br />to precipitation events in October and November. Outfalls 001, 002 and 020 discharged routinely <br />throughout the quarter. Outfall 021 discharged in response to dewatering operations. Outfalls 011, <br />020 and 021 were sampled for WET analyses during the quarter. No exceedances of WET test <br />limitations were observed. <br />It is noted that primary effluent limitations of TSS were exceeded at outfalls 001 and 020 during <br />intense fall precipitation events in October and November. The alternate limitations will be applied to <br />outfalls 001 and020 due to the fall precipitation event. The alternate limitations for Settleable Solids, <br />applicable in the event of discharged caused be precipitation less than or equal to the 10-year, 24-hour <br />precipitation event, was met at all outfalls. Based on a Memorandum of Understanding between the <br />Division of Reclamation, Mining and Safety and the Water Quality Control Division (WQCD), the <br />WQCD will be responsible for enforcing CDPS permit conditions including exceedances of TSS. <br />Thank you for the timely submittal. <br />If you have any questions feel free to contact me.
