Main ?`Q??uvcr? -' 'JAN 1 ? <br />Cortez, CO 81321 S ZQJ? <br />? pis o nqo F'o1d a <br />Re: Deadman Gulch channel amendment (Ak- 3? ion orpec?rfico <br />tlpn, <br />end safety <br />The submitted plans for construction of a diversion pipe to capture water flow from DeadmanGulch and prevent contact with the waste rock dump at the Golden Wonder Mine (case file # <br />COC-70513) by rerouting flows below the dump was reviewed by BLM specialists in <br />consultation with the U.S. Anny Corps of Engineers (USA COE) and the Colorado Division of <br />Reclamation, Mining and Safety (DRMS). The proposed design appears to be able to handle the <br />maximum anticipated flow rates for the Gulch. Verbal approval was again given to Kye <br />Abraham of LKA International during a meeting Gunnison on November 14th, 2008, realizing the <br />limited timeframe available for construction and the need to complete the pipe before spring <br />flows resume in Deadman Gulch. <br />It has been determined that this emergency action was necessary in order to prevent unnecessary <br />or undue degradation of public lands. A prior effort to reroute the water from the gulch was <br />attempted by the previous operator; this action resulted in saturation of the ground and slope <br />failure. <br />The entire plan amendment will.be reviewed and an appropriate NEPA analysis will be <br />conducted, as required under 43 CFR 3809, as the amendment exceeds the threshold of a minor <br />modification. <br />Additionally, please provide photo documentation of the pipe installation for o e rds.
