(Brannan) is requesting a reduction of the warranty amount for the MMRR <br />Quarry in Gilpin County (Permit No. M-2004-067). The local permit process has been stalled at <br />this time and, as a result, we have yet to begin any mining activities. There has been no activity <br />or disturbance at the proposed quarry site. We intend to continue to work toward obtaining the <br />local permits but will not begin any quarry activities until those permits are obtained. <br />In 2004, Clear Creek Water Providers (Brannan Sand and Gravel Co.) posted a bond with the <br />Division in the amount of $903,000. <br />Consistent with Rule 4.2.1(4), Brannan requests that, until such time as any actual mining <br />activity commences, the financial warranty amount for the MMRR Quarry be reduced to $10,000 <br />because that amount is more than sufficient to maintain the property in its current undisturbed <br />condition.
