IMNG & SAFETY <br />Grand Junction, CO 81501 / <br />RE: Yankee Gulch Minerals Project, Permit No. M-1999-002, Amendment No. 1 (AM-01) <br />Preliminary Adequacy Review w-o- <br />Dear Mr. Shuey: <br />We received your letter dated May 22, 2008 regarding the Adequacy Review of the <br />application for Amendment No. 1 to the Yankee Gulch Sodium Minerals Project, Permit <br />No. M-1999-002. Please accept this letter as a written request to extend the deadline to <br />address the adequacy issues you itemized in your letter. <br />Adequacy Comment No. 1 - American Soda acknowledges the inadequacy of the <br />previously provided map in providing the exact boundaries of the area in question. We will <br />used the requested extension time to coordinate the creation of a map containing the <br />elements you need as required in Rule 6.2. <br />Adequacy Comment No. 2 - American Soda will resolve the question regarding the <br />inclusion of the access road in the amendment. If required, an Amendment to the <br />application will be filed with the required re-publication and re-mailing. We acknowledge <br />that filing of an amendment to the application would reset the deadlines and review <br />timeframe. <br />Adequacy Comment No. 3 - American Soda will revise Exhibit N to provide the <br />documentation regarding our right to utilize the road to access our mine site. <br />Adequacy Comment No. 4 - There are no other mining related features (wells, ditches, <br />ponds, etc) in the subject area that have not been transferred to the new lessee that will <br />remain American Soda, L. L. P.'s responsibility to reclaim. <br />Adequacy Comment No. 5 - American Soda will remove the portion of the text addressing <br />removal of lands and associated infrastructures from the first paragraph of the Description <br />SCANNED
