Third Street Victor CO 80860 Re: Cripple Creek and Victor Amendment 9, Effects of Revisions on Storm Water Management Dear Timm: I have reviewed the proposed changes for the arrangement for the North Cresson, Schist Island and Globe Hill mining areas that are part of the Amendment No. 9 Application. It is my is understanding that those two mine areas will be backflled to result in the final contours shown on the revised drawings that you sent to me. The proposed revisions in that area will not necessitate any changes in the design or manner of implementation of the storm water management plan that I previously provided. My original plan showed collection ditches and sediment ponds EMP8b and EMP9 located in that area of the site. Those facilities were intentionally located at the perimeter of the disturbed area and along the boundary. The boundary has not changed and there is no need to realign the ditches or ponds, with the understanding that some minor realignment may be appropriate when the facilities are actually constructed if such modification will maximize the functionality of the storm water management. In addition, the contributing basins have not changed to a degree that would require resizing the facilities. In summary, then, in my opinion there will be no need to revise the original plans for storm water management because of the proposed revisions in the North Cresson mine areas. Steven D.
