Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Stipulation No. 20, RN-02, Lorencito Mine, #C-96-084 <br />Dear Mr. Thompson: <br />On November 25, 2008, the Division received the signed mining permit issued for <br />Permit Renewal No. 2 (RN-02) for the Lorencito Canyon mine. Upon review, we note <br />that the language included on the last page for Stipulation No. 20 is carried over from <br />Permit Renewal No. 1 and is slightly different from the stipulation as stated in the <br />written findings. The written findings issued for RN-02 correctly states the wording for <br />Stip No. 20 as: <br />Stipulation No. 20 <br />PERMIT RENEWAL NO. 2 (RN-02) IS A RENEWAL OF THE PERMIT AS A <br />RECLAMATION ONLY PERMIT. IN THE EVENT THAT THE LORENCITO CANYON <br />OPERATION IS PLANNED TO REOPEN FOR COAL MINING AND REMOVAL, THE <br />OPERATOR SHALL SUBMIT A PERMIT REVISION, RECEIVE APPROVAL FOR, AND <br />SUBMIT ANY INCREASE IN RECLAMATION BOND, PRIOR TO ANY ADDITIONAL <br />DISTURBANCE OF LANDS WITHIN THE PERMIT AREA. <br />Please retain a copy of this letter with the current mining permit that expires November <br />7, 2012. <br />We apologize for any inconvenience.
