Hernandez, Daniel
From: Hernandez, Daniel
Sent: Friday, December 12, 2008 3:26 PM
To: Musick, Jason
Subject: FW: [Fwd: SL-10 Proof of Publication]
V A
Proof of 20415330_WWCE_ ad.pdf (178 KB) Certified Return
ublication.pdf (130 . NOPR.pdf (2 MB) Receipts.pdf ...
Jason --
I spoke with Troy Summers today regarding his e-mail below. I informed him we could not
find the SL-10 application complete until we received proof that all four of the company's
public notices were actually published.
I mentioned that due to snow likely covering the reclaimed area, we would likely need to
postpone the site inspection until next Spring so that we could evaluate the vegetation
success. Troy said that there isn't a vegetation success component involved. I asked
Troy as to whether or not the SL-10 request involved requesting release on any reclaimed
sediment ponds. He said it did, but that Byron Walker had OK'ed the vegetation success on
a previous inspection, so there shouldn't need to be a vegetation success evaluation
conducted on this bond release application.
I'm not sure what Troy is talking about. Do you? Normally, reclaimed sediment ponds
requested for bond release need to be evaluated for reveg success in accordance with Rule
3.03.1(5). Perhaps Byron had mentioned the pond's reveg success in a previous inspection
report? It would be unusual for us to use an inspector's evaluation of reveg success of
an area being requested for release from a previous mine site inspection, but perhaps not
out of the realm of possibility.
Daniel I.
