Cattany, Director 5a G v f .. P/ of
Colorado Division of Reclamation Mining & Safety
1313 Sherman Street, Room 215 M'tq gg, I l Z
Denver, CO 80203
Dear Mr. Erickson, and.Mr, Caitany and others Whom Concern:
This letter constitutes notice that many entities and individuals in Southern Costilla
County, including l. ,as Coina,lb es de Saar Luis y el Condaclo de Costilla, the Rio Culebra
Agruicultural Cooperative; the Costilla County Committee for Environmental Soundness
(CES), The Acequia Associations and Organizations, The Costill.a County
Commissioners, the Town of San Luis, and others objecting to'the proposed Permit .
Amendment 3, DBMS Permit No. M-88-112, filed by Battle Mountain Gold on
December 2007.
WE do not believe that we were properly notified of this application. The Valley Courier
is not our local media source. '.Las (.bmadres de San Luis w: ere informed of this
application on 2.27.08, just prior to the deadline. Because you do not hear from this
community, please do noti Mass-u-me--- that there is no opposition.
We do not believe that the Mined Land Reclamation Boaxd has the authority to grant
Battle Mountain Gold water rights to irrigate the property, formerly known as the Shalom
branch, now being called the Salazar' Ranch. The NM cannot grant a change of
industrial/mining water to agriculture use. Nor should they be allowed to put water on
land that has no water rights.
I personally join the other entities from my cornfiiuxaity in contesting the assertion
by Battle Mountain Gold that the West Pit water is now of. pre-mining quality. I am very.
concerned about the contamination of the farmland, which is, adjacent to the Centennial
School District and the residents in the State's oldest Town of San Luis.
1 further object to:
L A proposal to close the water treatment facility located near the ltito Seco Creek
on the Battle Mountain Gold (BMG) property.
